What are some things to know about being terminated from a job?

If you lose your job and think you've been wrongfully terminated, it's important that you bring this to the attention of your attorney. Wrongful termination usually occurs when you're being discriminated or retaliated against, both of which are illegal in the eyes of the law.

What payments are you entitled to when you're terminated?

You are always entitled to the money you've earned at a job; you're entitled to your final paycheck and could be entitled to severance pay, too. You may also be entitled to receive payment for unused vacation time. Your payments must be received within a certain number of days following your termination; if you're not paid or are paid later than you should have been, you may be able to file a lawsuit against your past employer.

What do you do if you had an employment dispute before you were terminated?

Depending on the reason for the dispute, you may be entitled to damages for being terminated. For instance, if the dispute was over harassment in the workplace and you're fired for bringing it up, then the employer could be accused of wrongful termination due to retaliation. Anyone who is retaliated against or discriminated against should be in touch with an attorney who can help him or her understand and assert his or her rights.

What do you do if you're wrongfully terminated?

If you have been discriminated against or retaliated against, collect evidence. Do you have videos, dates and witnesses to conversations or other evidence of wrongdoing on the part of your employer? If your employer has violated state law, you can file a claim for compensation.
